Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement
I am fully aware and have been informed that:
- Climbing in the Kletterhalle Saalfelden can be dangerous and the risk of serious injury exists.
- Especially climbing in a group or if there are many other guests in the the Kletterhalle Saalfelden can create additional risks and dangers.
- Especially the incorrect use of the provided structures and safety equipment will create risks and additional dangers.
These risks and dangers include injuries, pain, emotional stress, trauma, illness and death, that may be caused by material defects, inadequate execution of a course of instruction or supervision of the employees, imperfect design or errors in the production of materials, collisions with persons or other structures in or around the Kletterhalle Saalfelden as well as climatic influences and any effects to the floors and surfaces to the area. With the entrance onto the area of the Kletterhalle Saalfelden I agree to accept all the risks and dangers, during my stay on the property. I confirm that I am aware of all the risks and dangers and that I waive the necessity of additional instructions.
I am fully aware and accept all the risks and dangers and I am giving the following Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement statement:
I waive any and all claims, also in the name of of my heirs, next of kin, executors, administrators, assigns and representatives, (including claims arising from damage or loss of personal property, injuries or death) during my use or stay in the Kletterhalle Saafelden against the Kletterhalle Saalfelden Betriebs GmBH & Co KG, and any Companies connected with the Kletterhalle Saalfelden Betriebs GmBH & Co KG including all their employees and representatives. I will accept all financial charges which could arise from medical attention, medical care or any other costs that could occur.
I agree that I will, without limitation, also in the name of of my heirs, next of kin, executors, administrators, assigns and representatives, compensate the Kletterhalle Saalfelden Betriebs GmBH & Co KG, and any with the Kletterhalle Saalfelden Betriebs GmBH & Co KG connected companies including their employees and representatives for all damages that I directly or indirectly during the use of the Kletterhalle Saalfelden may cause, regardless of its kind (cost for repairs, damages for pain and suffering etc. ) including legal costs up to the legal limit. In the case that I cause any damage to any structures or equipment of the Kletterhalle Saalfelden I agree to inform the Kletterhalle Saalfelden Betriebs GmBH & Co KG and pay for the costs arising out of the incident.
In connection with this Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement only the herein stated clauses are valid. That means, that any statements, concerning the risks and dangers arising from the use of the Kletterhalle Saalfelden, made orally or in writing by third parties are not binding or valid.
I state that I am entering the area and facilities of the Kletterhalle Saalfelden on my own will and that I am able to understand the risks and dangers fully. Based on that I state that:
- I will accept and follow any instructions given by the employees, that I will observe any instructions given by the producers and manufacturers of the offered structures and equipments.
- I agree to use during my visit to Kletterhalle Saalfelden the for climbing necessary and standardized equipment correctly.
- I accept and agree that my name and all photos, movies or any other multimedia that may be taken by the Kletterhalle Saalfelden Betriebs GmBH & Co KG can be used and published by the Kletterhalle Saalfelden without further consent. I have been informed that I am able to withdraw this consent at any time with an e-mail to office@felsenfest.cc and after the receipt of this email the Kletterhalle Saalfelden has no longer the permission to publish this data.
- I confirm that I am in good physical condition and that I do not have any physical or psychological conditions that would inhibit or prohibit the use of the Kletterhalle Saalfelden.
- I confirm that I had the opportunity to visibly inspect the Kletterhalle Saalfelden and that I was able to address any questions I had with an employee or representative.
- I was able to check all necessary equipment and I was able to confirm that everything was in good and sound mechanical condition.
This Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement is under Austrian Legal Jurisdiction with the exception of rules of the private international law. All legal proceedings will be addressed in the Court of Jurisdiction at the Bezirksgericht Saalfelden or the Landesgericht Salzburg.
This Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity.
I confirm that I have read this Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement and that I fully understand and accept the content set out in this agreement.
